You are responsible for creating a complex password to protect your Membership account and for ensuring that you do not share your password with others. To qualify for Rewards, be logged in to your Member account at the time of your purchase at www.marchgear.com. To receive information about the Membership, your account, and Rewards, you must provide and maintain a valid email address on your account. By becoming a Member, you agree to receive advertising, marketing materials, and other communications relating to your Membership account from MARCH GEAR. You will receive transactional messages regarding your account regardless of whether you choose to opt out of marketing/promotional messages, including, Reward Coupon Code emails, and other Membership related messages. Please note that email is the only source of communication for the Membership Program. After opting out of marketing emails, you will continue to receive Rewards, discount and bonus notifications and reminders as well as account balance summary emails so long as you remain enrolled in the Membership Program.

MARCH GEAR is not responsible for lost, delayed, stolen, damaged, incomplete, invalid, misdirected, or undeliverable communications, including Rewards, or for technical failures of any kind, including but not limited to electronic malfunctioning of any network, hardware or software, technical or human error. If there is a dispute as to the identity of a Program Member, the authorized account holder of the email address associated with the Membership account will be deemed the Program Member if they provide identification reasonably acceptable to MARCH GEAR that is consistent with the name on the account. You are responsible for anything that happens through or involving your account until you close down your account or prove to MARCH GEAR’s reasonable satisfaction that your account security was compromised due to no fault of your own. 

 

Rewards can be earned from purchases of all Qualifying merchandise and can be used toward the Qualifying Merchandise Purchase in an amount equal to or greater than the amount of the sum of the Rewards presented for redemption. No cashback will be provided if the Rewards full value is not utilized. Purchases of the following items are excluded from earning Rewards: purchases of gift certificates or gift cards, sales tax, state fees, shipping charges, delivery charges or other excluded charges specified by MARCH GEAR from time to time. Unless otherwise noted in email with the issued Reward Coupon Code, each Reward will expire if not redeemed within 12 months from the date of issuance. You must be an active Member in good standing at the time of  issuance and redemption. Other conditions and exclusions may apply. Rewards have no cash value, are void where prohibited, are not transferable, do not constitute the property of the Member, and may be used only once, and consequently carry no cash value.  If a Qualifying Purchase is returned, Rewards will be deducted from your refund in an amount equal to the corresponding rewards posted for the portion of the Qualifying Purchase that is returned. 

MARCH GEAR Rewards or any other discounts and bonuses may be used by Members at www.marchgear.com only and are not valid at any  other stores or online retailers that carry MARCH GEAR merchandise. 

 

Membership is available to individuals for their personal, private use. Employees of MARCH GEAR or its affiliates are not eligible for Membership Rewards, bonuses and discounts. By providing your personal information to MARCH GEAR, you acknowledge that you fully understand and unambiguously consent to the transfer of such personal information to MARCH GEAR. When enrolling in the MARCH GEAR Membership you acknowledge that you are a resident of the U.S. and are 13 years of age and the age of majority in your jurisdiction or if you are not the age of majority in your jurisdiction that you have obtained permission from your parent or legal guardian to become a Member. Furthermore, you accept these Membership Terms and Conditions (“Terms”), and that the information you provide to MARCH GEAR is truthful and accurate.

MARCH GEAR reserves the right to modify, terminate, amend, limit, or otherwise change the Membership and these Terms, including but not limited to Membership benefits, conditions of participation, reward rates, or any other aspect of Membership, in whole or in part, at any time with or without notice, even though changes may affect the value of any accumulated rewards. Changes to these terms will be posted at www.marchgear.com  Your continued Membership after changes have been posted constitutes your acceptance of the changes. If you do not agree to any changes, you must cancel your Membership.

 

By establishing a MARCH GEAR Member account you agree that any information you share, post and submit to MARCH GEAR Forum and/or Members Portal you have the lawful right to provide, share and post. You represent that you are solely responsible for selecting the content of communications that you transmit using the Membership, including ensuring that such content complies with all applicable laws. Any information you submit to MARCH GEAR Forum, Members Portal and account is at your own risk of loss. By providing such information, you covenant that you are entitled to submit the information, and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights. Additionally, you grant MARCH GEAR a nonexclusive, worldwide, unlimited, and royalty-free right to copy, improve, distribute, publish, remove, retain, add, process,  and use in any way. Any information you provide to MARCH GEAR, may be used by MARCH GEAR to populate your profile, ideas, concepts, techniques or data, without any further consent, notice and/or compensation to you or to any third parties.

To be eligible to use the Membership account you hereby pledge that  you are not currently restricted or not otherwise prohibited from having a Membership account,  are not a competitor of MARCH GEAR, or are not using the Membership account for reasons that are in competition with MARCH GEAR. You agree to only maintain one Membership account at any given time, and  have full power and authority to open a Membership account. You will not violate any rights of MARCH GEAR, including intellectual property rights such as copyright or trademark rights, in addition you will not violate any rights of other Members.

You will fully indemnify, defend and hold us harmless for all damages, losses and costs (including, but not limited to, reasonable legal fees and costs), fines, administrative monetary penalties or settlement costs, related to all third party claims, charges, regulatory and other investigations, caused by your failure to comply with these Terms, including, without limitation, your submission of content that violates third party rights or applicable laws. You will further indemnify, defend, and hold us harmless from any and all losses arising from any breach or claim arising from your Membership activity, and any content you submit to the Membership Portal and Forum through your Membership Account. 

 

MARCH GEAR hosts various Forums where you can post your observations and comment on designated topics. MARCH GEAR also enables sharing of information by allowing Members to post updates, including links to third party content, and other information such as events, promotions, and other content to their profile and other parts of the site. MARCH GEAR Members can create Profile Pages, posts and enter discussions, however, MARCH GEAR may close accounts or remove content from any Pages if the content violates these Terms or others’ intellectual property rights.

 

Please note that ideas you post and information you share may be seen and used by other Members, and MARCH GEAR cannot guarantee that other Members will not use the ideas and information you shared. MARCH GEAR is not responsible for Members misuse of any content you post on any pages hosted by MARCH GEAR in any manner. You acknowledge and agree that MARCH GEAR is not responsible for any content or information posted by you or any other Member on any Member accessible page hosted by MARCH GEAR.

 

You are solely responsible for your interactions with other Members. MARCH GEAR reserves the right, but has no obligation, to monitor disputes between you and other members and to restrict, suspend, or close your account if MARCH GEAR determines, in our sole discretion, that doing so is necessary to enforce these Terms. MARCH GEAR does not have any obligation to verify the identity of the persons subscribing for Membership, nor does it have any obligation to monitor the use of its services, therefore MARCH GEAR disclaims all liability for identity theft, any misuse of your information or your identity. You may close your Membership account at any time for any reason, such termination shall be your sole and exclusive remedy.

 

MARCH GEAR reserves the right to cancel, modify, restrict, or terminate the MARCH GEAR Rewards Program at any time without prior notice. MARCH GEAR also reserves the right to cease communication with and terminate the account of any member at its sole discretion. All interpretations of MARCH GEAR Rewards Program terms and conditions shall be at our sole discretion. MARCH GEAR  reserves the right to make promotional offers available to select members based on purchase activity, participation, or other factors. Our failure to exercise or enforce any right or provision of these rules shall not constitute a waiver of such right or provision.

 

Member is responsible for any tax liability related to his/her participation in the Member Program or for his/her Qualifying (or other) Purchases. 

When a Member becomes inactive for a continuous (rolling) 24-month period, the Membership may be automatically cancelled by MARCH GEAR on or after the last day of the 24th month of account inactivity. Any Member may cancel his/her membership at any time by notifying MARCH GEAR by email. Please note that it may take up to 4 weeks to process the request. When Membership is cancelled and a Member's account is closed for any reason, any outstanding, Rewards, bonuses or discounts in the Member’s account will be forfeited without notice or compensation.

 

Abuse of the MARCH GEAR Rewards program, including any inappropriate behavior in the Forum, inappropriate posting, harassing or bullying of other members,  including failure to follow program policies and procedures, the sale or barter of Rewards, products, promotional offers, using multiple accounts in an effort to abuse the MARCH GEAR Membership, suspected fraud, and any misrepresentation of fact relating thereto or other improper conduct as determined by MARCH GEAR in its sole judgment, may result in cancellation of the member’s account and future disqualification from program participation, forfeiture of all Rewards accrued, cancellation of previously issued but unused reward certificates or codes, and termination of the business relationship with MARCH GEAR. In connection with the enforcement of any of the terms and conditions governing the MARCH GEAR Membership, MARCH GEAR reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys’ fees and court costs. MARCH GEAR failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights. MARCH GEAR reserves the right to interpret and apply the policies and procedures communicated in these Terms in its sole and absolute discretion. 

 

Resellers are specifically excluded from the program. MARCH GEAR reserves the right not to award Rewards, to invalidate improperly issued Rewards for any items purchased for resale, as well as to terminate the Membership and decline to permit anyone we believe is associated with the resale activity, or the account, to enroll in any MARCH GEAR Membership or other program, if we so desire. MARCH GEAR has sole discretion over whether to deem any purchase a “purchase for resale”.

 

MARCH GEAR Membership is subject to all applicable laws and regulations and is void where prohibited by law. You agree to fully and unconditionally accept the decisions of MARCH GEAR, which are final and binding in all matters related to the Membership, your purchases, and these Terms. These Terms supersede all previously published terms and conditions related to the Program. MARCH GEAR reserves the right to interpret and apply the policies and procedures communicated in these Terms in its sole and absolute discretion. If any provision of these Terms is unlawful, void or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. The Membership, your Qualifying Purchases, and these Terms will be governed by and construed under the laws of the State of Ohio applicable to agreements made and to be entirely performed within the State of Ohio, without regard to any conflict of law provisions. You agree that any action not filed in arbitration pursuant to these Terms and Conditions shall be filed only in the state and federal courts located in Cuyahoga County, Ohio and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any such suit, action or proceeding.

 

The MARCH GEAR logo, and  any other logos, trademarks, and trade names of MARCH GEAR are the intellectual property of MARCH GEAR or its affiliates. MARCH GEAR grants you limited permission to access and use this site for personal use. We do not give permission to download or modify any part of it. Limited permission does not allow any commercial use of this site or its contents, any data gathering, downloading, or copying of account information for the benefit of another merchant. No portion of this site (including images, text, form, or page layout) may be copied, duplicated, reproduced, sold, visited, or otherwise exploited for commercial purposes without the express written consent of MARCH GEAR.
